General Terms and Conditions BUYnBLUE Onlineshop

 

1. scope of application

All legal transactions carried out via the online store https://www.buynblue.com/ are subject to the General Terms and Conditions ("GTC"). The online store is operated by eVolution Commerce GmbH.

BUYnBLUE reserves the right to amend these GTC at any time. The version valid at the time of the order shall apply. This can be viewed at https://www.buynblue.com/pages/agb.

 

2. offer

Products and prices in the online store are considered offers. The offer is valid as long as the product can be found in the online store and is in stock.

 

3. products, prices and payment methods

The displayed product prices are final prices and include the statutory VAT of the respective country. BUYnBLUE is free to set prices and change them at any time. When placing an order, the prices published on the website shall prevail. BUYnBLUE reserves the right to notify buyers prior to shipment to agree to price corrections or to cancel orders if prices have been published in error.
By default, prices are quoted in Swiss francs (CHF).

Shipping and packaging costs, as well as the VAT included, are shown at checkout.

Any cash on delivery with the selected logistics partner is the sole responsibility of the customer.

The payment methods listed on the checkout page are available.

 

4. information provided

BUYnBLUE endeavors to keep the data published in the online store up to date and correct. However, due to production/delivery bottlenecks and sales via other channels, there may be delays in delivery. Therefore, all information on availability and delivery times is without guarantee and may change at any time.

BUYnBLUE assumes no liability for the accuracy and timeliness of information from other manufacturers, even if it has been carefully researched.

 

5. conclusion of contract

A purchase contract is concluded when an order is sent (online) and accepted by BUYnBLUE .

A prerequisite for an effective purchase contract is the complete and truthful completion of the order form available on the Internet and the acceptance of these General Terms and Conditions (GTC).

BUYnBLUE confirms receipt of the order by means of an automatically generated order confirmation email. This only shows the customer that the order has been received and that the purchase contract has been signed with the correct delivery conditions and prices.

 

6 Delivery conditions and availability

Products marked "in stock" are usually delivered within 5-20 working days between Monday and Friday after receipt of the order.

The delivery service is not available on Saturday and Sunday.
If a product is not in stock or is incorrectly marked as "in stock", customers will be notified by e-mail or telephone and a new interim delivery date will be agreed. BUYnBLUE endeavors to make subsequent deliveries quickly and returns orders without increasing the shipping costs.

If an item is no longer available and BUYnBLUE can no longer purchase or produce it, BUYnBLUE may withdraw from the contract, but must refund the customer the full amount paid for the product in question.

If additional shipping costs are incurred due to incorrect delivery addresses or incorrect address data, these shall be borne in full by the buyer.

Depending on availability, goods are dispatched from department stores in Switzerland or in Asia. Deliveries to EU countries and the USA are duty paid and taxed. Customs and import duties incurred for deliveries outside the EU and USA are to be borne by the customer. It is the customer's responsibility to find out about the current customs regulations in his country.

National and international orders are shipped with DHL, DPD, Fedex, UPS or the local post office. The terms, information and conditions of the respective logistics partner apply.

 

6.1 Additional provisions Delivery

If the customer does not accept the goods delivered by the supplier within the agreed or specified delivery time, BUYnBLUE may withdraw from the contract, cancel the order and charge the customer a processing fee of 10%, but at least CHF 25. Fees paid to third parties (payment processors) as part of an order will not be refunded.

 

7. inspection obligations

Delivered or collected products must be checked by the buyer immediately after acceptance for completeness, correctness and delivery damage. Defects must be reported to BUYnBLUE within 7 calendar days. 

Failure to comply with the above-mentioned deadline shall invalidate the warranty for these defects.

 

8 Warranty conditions and services

BUYnBLUE sells articles from other manufacturers.

BUYnBLUE has no influence on the service life and functionality of the product or on other manufacturer warranties. The manufacturer's warranty details therefore apply, insofar as these are valid in Switzerland and the EU. Otherwise, the EU-wide statutory warranty of 2 years applies. 

In the event of defective delivery, the buyer is entitled to rectification or subsequent delivery. Cancellation and reduction are excluded.
Warranty claims can only be asserted by the customer on presentation of a purchase contract with a valid order.
There are no warranty claims for damage caused by improper handling or defects attributable to external influences. This may include, for example, damage caused by the elements, moisture damage, drop and impact damage or damage caused by modifications.

 

9 Liability and exclusion of liability

BUYnBLUE is only responsible for the warranty services listed in section 8. BUYnBLUE accepts no further liability, in particular no liability for damage that has not occurred to the product itself. These can be indirect and consequential damages as well as consequential damages such as lost profits, unrealized savings or damages due to delayed deliveries. Furthermore, BUYnBLUE is not liable for damage caused by improper storage.

 

10. payment

The goods invoice is to be paid in the currency stated therein and immediately upon or after sending the order.

The following payment methods are accepted in the online store: Credit cards (Mastercard, Visa, American Express), Klarna, Twint, Sofortüberweisung and PayPal.

 

11. right of withdrawal and revocation

As the purchaser, you have the right to withdraw from this contract within fourteen days without giving reasons.

The withdrawal period begins on the day on which you take delivery of the goods and does not apply to replacements, exchange products or custom-made products. In order to assert the right of withdrawal, the items must be in their original packaging and undamaged.

If you wish to exercise your right of withdrawal, you must inform us of this decision by sending us a declaration signed by you by post or e-mail to [email protected] at eVolution Commerce GmbH Löhrstrasse 53, 4552 Derendingen, Switzerland.

The date of dispatch of your declaration of revocation is decisive for compliance with the revocation period.

 

11.1 Consequences of revocation

In the event of withdrawal, we will refund all payments made by you, including delivery costs, within a maximum of 14 days after receipt of the withdrawal. The refund will be made using the same payment method that you selected when placing the order. Changes to the payment method are possible by arrangement.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

In the event of a loss in value of the goods, you are responsible for this if it is due to use that exceeds the examination of the properties, condition or function of the goods.

 

12. data protection

BUYnBLUE only collects the personal data necessary for the conclusion of a contract. These are not processed further without the separate consent of the buyer. Data will only be passed on to third parties if this is necessary to process the order. In the case of home delivery, this applies to logistics partners (e.g. post offices) and banks for payment processing.

 

13 Application of law and place of jurisdiction

The relationship between BUYnBLUE and its customers is governed entirely by Swiss law. The place of jurisdiction is the city of Solothurn in the canton of Solothurn, Switzerland.

 

14 Alternative dispute resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link https://ec.europa.eu/consumers/odr

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.

 

14.1 Participation in dispute resolution proceedings

As a seller, we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
